1. Introduction
This Privacy Policy ("Policy") describes how Supra 3D Capture ("the App", "we", "us", or "our") may collect, use, process, transmit, or store information in connection with your installation and use of the App. The App is a Shopify application that lets merchants capture physical products in 3D using phone-based photogrammetry and publish the resulting models to their Shopify storefronts.
By installing or using the App, you acknowledge and agree that your information may be handled in the ways described below. This Policy does not constitute a contract, commitment, or guarantee of any kind. We reserve full discretion over our data practices except where prohibited by applicable law.
2. Information We May Collect
2.1 Data provided by Shopify
Upon installation, Shopify may provide us with information about your store, your identity as a merchant, your subscription status, and any data necessary for the App to function. We may access, retain, or store this data to the extent we deem useful for operation, analytics, compliance, billing, or business purposes.
2.2 Media, files and content you upload
You may upload or transmit photographs, videos, 3D models, product references, prompts, text, descriptions, or other media ("User Content"). By providing User Content, you grant us all rights necessary to process, handle, reproduce, transform, store, or transmit that content for any operational or functional reason related to providing or improving the App, including running it through third-party photogrammetry and computer-vision processors.
2.3 3D processing and external processors
Your content may be forwarded to third-party photogrammetry vendors, cloud GPU processors, machine-learning model providers, storage services, content delivery networks, or other external systems ("External Processors"). We do not control these External Processors and are not responsible for their actions, storage practices, retention policies, or security procedures.
2.4 Technical, diagnostic and usage data
We may collect any form of technical, diagnostic, performance, or usage data that we find relevant to operating or improving the App, including server logs, request metadata, timestamps, device information, user-agent strings, IP addresses, and feature-level analytics.
2.5 Billing data
Billing is processed by Shopify. We do not directly handle or store payment card information. We may receive transaction-level data (plan tier, billing date, amount) from Shopify and store it for operational, accounting, and audit purposes.
3. How We May Use Information
We may use information for any of the following purposes, at our sole discretion:
- Operating, delivering, or modifying App functionality
- Running 3D reconstruction, photogrammetry, optimization, and related compute operations
- Generating model previews, banner thumbnails, and storefront-ready assets
- Analysis, debugging, monitoring, internal research, and product improvement
- Compliance with Shopify requirements or legal obligations
- Preventing misuse, abuse, or fraud, and addressing technical issues
- Business operations including backup, archival, auditing, and administrative purposes
No specific use-case listed above should be interpreted as limiting our ability to use data in other lawful ways related to the operation or improvement of the App.
4. Data Storage & Retention
We may store information, including media, generated 3D models, and User Content, for as long as we deem necessary or useful for operational, security, business, archival, compliance, or legal purposes. We make no guarantee regarding deletion timelines, retention duration, or storage methods, and you should not rely on us as your primary backup.
5. Sub-processors and Sharing of Information
We may share information with any of the following parties:
- Cloud compute and storage providers (including object storage providers such as Cloudflare R2 or Amazon S3)
- Photogrammetry and 3D reconstruction processors
- Content delivery networks for serving model files and images
- Analytics, error tracking, and observability services
- Email or notification providers used for transactional messages
- Legal, regulatory, or governmental authorities when we believe disclosure is required
We are not responsible for how external parties handle data once it is transmitted to them. The list of sub-processors may change at any time without notice.
6. International Transfers
Your data may be transmitted to and processed in multiple jurisdictions, including those with different data-protection standards than your own. By using the App, you consent to such transfers.
7. GDPR (European Economic Area & UK)
If you are located in the EEA or the UK, you may have certain rights with respect to your personal data, including the right to access, correct, or request deletion of certain information, subject to legal limits and our legitimate business interests. Where we process personal data, we rely on one or more of the following legal bases: performance of a contract (operating the App you installed), legitimate interest (operating, securing, and improving the App), legal obligation (responding to lawful requests), and consent where required.
8. CCPA / CPRA (California Residents)
If you are a California resident, you may have rights to know, delete, or opt out of the "sale" or "sharing" of certain personal information under the CCPA / CPRA. 9. Security
We use commercially reasonable measures to protect data; however, we do not guarantee security, confidentiality, integrity, or availability of any information. You acknowledge that transmitting data through the App, the internet, and any External Processor involves inherent risks. To the maximum extent permitted by law, we disclaim all liability for unauthorized access, interception, loss, or alteration of data.
10. Your Responsibilities
You are solely responsible for ensuring that:
- You have all necessary rights and permissions to upload, process, and publish content through the App
- Your content complies with applicable laws, including privacy, publicity, copyright, and trademark laws
- The physical products you capture are owned by you, or you have permission to capture and publish their 3D likeness
- Your use of the App complies with Shopify's policies and your local regulations
- Any 3D models or media you publish to your storefront comply with applicable advertising and consumer-protection laws
We disclaim any responsibility for User Content or for legal issues arising from your use of generated 3D models.
11. No Warranty & Limitation of Liability
The App is provided on an "as-is" and "as-available" basis without warranties of any kind. To the maximum extent permitted by law, we disclaim all liability for:
- Loss, alteration, misuse, or unauthorized access to data
- Actions, omissions, or failures of External Processors
- Output accuracy, fidelity, completeness, or suitability of 3D reconstructions
- Any direct, indirect, incidental, consequential, exemplary, or punitive damages
Your use of the App is entirely at your own risk.
12. Cookies and Local Storage
We may use cookies, local storage, or similar technologies in the admin portion of the App for authentication, session management, preferences, and analytics. The marketing website may use cookies to measure aggregate traffic. You can disable cookies through your browser settings, though some features may stop working.
13. Data After Uninstall
Uninstalling the App removes our active access to your store through Shopify. We may retain any stored data, including generated 3D models and original capture images, for any duration we deem appropriate unless we are legally required to delete it. We are not obligated to provide copies of any data after uninstall.
14. Children
The App is not directed to children under 16, and we do not knowingly collect personal information from children. If you believe we have inadvertently collected such information, contact us so we can take appropriate steps.
15. Policy Changes
We may update or modify this Privacy Policy at any time without prior notice. The most recent version will always be posted at this URL. Your continued use of the App after any update constitutes acceptance of the revised Policy.
